1. Platform Overview

A&R DUTY is an AI-powered A&R infrastructure platform designed to assist music industry professionals with talent discovery, AI-driven scouting reports, artist development, and marketplace connections. By accessing or using A&R DUTY, you agree to be bound by these Terms & Conditions.

2. User Eligibility

You must be at least 18 years of age to use the platform. By registering, you confirm that all information you provide is accurate and up to date. A&R DUTY reserves the right to suspend or terminate accounts where false or misleading information has been submitted.

3. User Responsibilities

As a user of A&R DUTY, you agree to:

• Use the platform only for lawful purposes and in accordance with these Terms.
• Refrain from uploading fraudulent, misleading, or infringing content.
• Not attempt to circumvent platform security, reverse-engineer any features, or access accounts other than your own.
• Respect the intellectual property rights of artists, producers, and other users on the platform.

Violation of these responsibilities may result in immediate account suspension or termination.

4. Intellectual Property

All A&R DUTY branding, software, AI systems, designs, and content (excluding user-submitted material) remain the exclusive property of A&R DUTY. You may not reproduce, distribute, or create derivative works from our platform without prior written consent.

User-submitted content (e.g. uploaded tracks, profile information) remains your property. By uploading content, you grant A&R DUTY a limited, non-exclusive license to use it solely for the purpose of providing the requested services (e.g. AI analysis).

5. Marketplace & Payments

Transactions conducted through the A&R DUTY marketplace are subject to additional terms specific to those services. Marketplace interactions may include platform commissions and escrow-style protections to ensure fair dealing between parties.

All subscription fees, marketplace fees, academy tuition, credit purchases, and service payments are non-refundable unless otherwise required by applicable law or expressly stated in a written agreement. Where refunds are approved, A&R DUTY reserves the right to deduct applicable transaction fees, processing charges, or service costs already incurred.

Users may cancel recurring subscriptions at any time; however, cancellation does not entitle the user to a refund for the current billing period. For billing inquiries, contact support@aandrduty.com.

6. No Guarantee of Success

A&R DUTY provides AI-powered tools and marketplace access to support your music career journey. However, we do not guarantee commercial success, record deals, brand partnerships, or any specific outcome resulting from use of the platform. Results depend on many factors outside our control.

7. Account Suspension

A&R DUTY reserves the right to suspend or terminate any account found to be in violation of these Terms, engaging in fraudulent activity, or otherwise acting in a manner detrimental to other users or the platform. Where possible, we will provide notice prior to suspension.

8. Limitation of Liability

To the fullest extent permitted by law, A&R DUTY shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount you have paid to A&R DUTY in the three months preceding the claim.

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any dispute arising from or relating to the use of A&R DUTY shall be subject to the exclusive jurisdiction of the courts of Nigeria.

10. Dispute Resolution

Before commencing legal proceedings, users agree to attempt to resolve disputes through good-faith negotiations with A&R DUTY. If a dispute cannot be resolved amicably, the matter shall be submitted to mediation or arbitration before pursuing litigation, where permitted by applicable law.

11. Modifications

We reserve the right to update these Terms & Conditions, our services, pricing, and platform features at any time. Material changes will be communicated to registered users where reasonably practicable. Continued use of A&R DUTY following any update constitutes your acceptance of the revised terms.
